Terms of Use
1. General provisions and acceptance
These Terms of Service (the Terms) govern the relationship between Goup Space Sp. z o. o., registered office ul. Hoża 86/210, 00-682 Warszawa, Poland, KRS 0000932799, REGON 520583134, NIP 7011061440, e-mail info@pages.otack.eu (the Operator), and any natural or legal person who registers an account on the Platform (the User). Registration on the Platform constitutes acceptance of these Terms.
2. Definitions
- Platform — the web application operated by the Operator at pages.otack.eu and its sub-domains.
- User — a natural person at least 16 years old, or a legal person, holding an Account.
- Account — the User's personal area on the Platform, secured by a password.
- Generated Site — a multi-page website produced through the Platform on the User's behalf.
- Access Pass — a one-time, non-renewing entitlement to the paid features of the Platform for 30 or 90 days.
- Trial — free demo access offered at the Operator's discretion during the demo phase.
- Consumer — a natural person acting outside their business or professional activity.
- Entrepreneur — a natural or legal person acting in connection with their business or professional activity.
- AI Provider — a third-party AI service called by the Platform (Anthropic, OpenAI, Google, Moonshot or compatible).
- Sub-processor — any third party engaged by the Operator to process personal data on the User's behalf.
- Stripe — Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland.
- Content — any text, image, code, prompt or other material submitted, generated or published through the Platform by the User.
3. Description of the service
The Platform offers AI-driven generation of multi-page websites, a visual editor, export of the site as a ZIP archive, SFTP deployment, otack-cms or Crafto package, and multilingual generation. Hosting of Generated Sites on Operator-controlled subdomains is a planned future feature and is not yet generally available.
The Platform is provided "as is". The Operator does not warrant that AI-generated output is accurate, lawful, unique, free of third-party rights or fit for any particular purpose. The User must review all output before publication and is solely responsible for the content the User publishes. The Operator does not warrant uninterrupted or error-free operation of the Platform.
4. Technical requirements
The User needs a current version of Chrome, Firefox, Safari or Edge, JavaScript and cookies enabled, a stable Internet connection, and unrestricted reachability of the Stripe checkout domain from the User's network. The support channel is info@pages.otack.eu; the Operator acknowledges support requests within a reasonable time.
5. Registration, Account and minimum age
The User must provide accurate data on registration and is responsible for the confidentiality of the password and for activity under the Account. One Account is permitted per natural or legal person. By registering the User confirms being at least 16 years old, the digital-consent age under GDPR Article 8 as implemented in Poland. Accounts of persons under 16 may be terminated. The Operator may also block an Account for breach of these Terms, as described in Section 13.
6. Status of buyer (Consumer or Entrepreneur)
At purchase the User indicates whether they buy as a Consumer or as an Entrepreneur. A sole proprietor concluding the agreement in a non-professional capacity benefits from consumer protections to the extent provided by Article 7aa of the Polish Consumer Rights Act of 30 May 2014 (ustawa o prawach konsumenta, the UoPK). The Operator may seek reasonable confirmation of business status.
7. AI keys and AI providers
The User may bring their own API key for an AI Provider. The key is encrypted in the User's browser using PBKDF2 and AES-256-GCM under a password chosen by the User. The Operator never receives that password, does not persist the key in any readable form and does not log it.
When the User makes an AI request, the key is transmitted over TLS and held in server memory only for the duration of the single request needed to relay it to the chosen AI Provider. For asynchronous generation jobs the key is encrypted at rest in the internal job queue with AES-256-GCM and is erased after processing.
The User is responsible for compliance with the chosen AI Provider's terms and for any usage charges under the User's own key. During the demo or trial phase the Operator may provide a platform-key fallback; in that case the AI Provider acts as a sub-processor of the Operator for processing the User's prompts.
8. Acceptable use and prohibited content
The User must not use the Platform to generate, store, host, distribute or publish:
- malware, phishing pages, credential-harvesting forms or any content compromising the security of users or third parties;
- sexually explicit content depicting minors, or any content sexualising minors;
- content inciting violence, hatred or discrimination on protected grounds;
- content infringing third-party intellectual property or trade-mark rights;
- content unlawful in Poland or in the jurisdiction where the Generated Site is published;
- automation violating rate limits, circumventing platform controls, or scraping the Platform;
- false personation of others, fraudulent commercial offers, or content prohibited by the Stripe Acceptable Use rules.
The Operator may remove the offending content and suspend or terminate the Account as described in Section 13.
9. Notice-and-takedown for hosted Generated Sites
Once Operator-hosted subdomain hosting becomes available, any person may notify the Operator of allegedly unlawful content on a Generated Site by writing to info@pages.otack.eu with the URL, identification of the content, and the legal basis of the claim. The Operator handles such notices in accordance with Articles 14 and 16 of Regulation (EU) 2022/2065 (the Digital Services Act) and the Polish implementing legislation. The Operator may take down or restrict access to the reported content and will notify the affected User of the action and its grounds.
10. Intellectual property
Content the User creates or uploads to the Platform — text, images, code — remains the property of the User. The Platform itself, including its source code, templates, AI prompts and design system, remains the property of Goup Space Sp. z o. o.
The User grants the Operator a non-exclusive, royalty-free, worldwide licence to host, store, transmit, cache and display the User's Content strictly to operate the hosted-site feature and provide the Platform. The licence terminates on deletion of the Content or the Account. Its scope is set within Articles 41 and 50 of the Polish Act on Copyright and Related Rights of 4 February 1994.
The Operator uses customer references (logo, name) only with the User's explicit prior opt-in consent.
11. Access Pass, payment and trial
Paid features are offered as a one-time Access Pass for 30 or 90 days. There is no subscription, no automatic renewal and no automatic charge. Payments are processed by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland. All prices are in United States dollars (USD). Trial / demo. During the demo phase the Operator may offer free Trial access. The Trial is provided free of charge, generates no payment obligation and is non-refundable. The Operator may change or discontinue the Trial at any time.
12. Waiver of the consumer right of withdrawal
For a Consumer, Article 27 of the UoPK normally grants a 14-day right of withdrawal from a distance-concluded agreement. For digital services and digital content that right is lost where the Consumer (a) expressly requests immediate provision of the service before the 14-day period elapses and (b) acknowledges that doing so causes the loss of the right of withdrawal, as provided by Article 38 point 13 of the UoPK.
At checkout the Consumer is presented with two separate non-pre-ticked check-boxes capturing exactly these two declarations. Without both check-boxes the order does not proceed. The wording of those check-boxes is incorporated into these Terms by reference.
13. Suspension and termination for breach
If the Operator identifies a material breach by the User — for example a violation of Section 8 (Acceptable Use) or fraudulent payment activity — the Operator may block Account access, notifies the User by e-mail of the suspension and its grounds, and allows the User a cure period of 14 to 30 days proportionate to the gravity of the breach. If the User fails to cure or to rebut the alleged breach within the cure period, the Operator may terminate the Account and delete the User's data, subject to any legal retention obligations. The User may complain against the suspension by writing to info@pages.otack.eu.
14. Complaints
Under Article 8.1.4 of the Polish Act on Providing Services by Electronic Means of 18 July 2002 (ustawa o świadczeniu usług drogą elektroniczną, the UoŚUDE), the User may file a complaint regarding the Platform by writing to info@pages.otack.eu within 30 days of the event giving rise to the complaint. The complaint should identify the Account, the issue, the date and the circumstances. The Operator considers complaints and responds within 14 calendar days of receipt.
15. Liability
To the maximum extent permitted by applicable law, the Platform is provided "as is" and the Operator excludes liability for:
- inaccuracy, unlawfulness or unsuitability of AI-generated output;
- unavailability or interruptions of the Platform;
- acts or omissions of third-party AI Providers, payment processors, hosting providers and telecommunications carriers;
- loss caused by the User's own acts or omissions;
- events of force majeure, including war, sanctions, natural disasters, large-scale telecommunications outages, AI-provider outages, Stripe outages, and government action.
The Operator's aggregate monetary liability arising under or in connection with these Terms is limited to the total amount actually paid by the User to the Operator in the twelve (12) months preceding the event giving rise to the claim; for a User who has made no payments the cap is zero.
The limitations of liability in this Section do not exclude or limit (a) liability for intent or gross negligence; (b) liability for harm to life or health; (c) any liability that cannot be excluded under Polish or European Union mandatory law; (d) the mandatory consumer-protection rights of a Consumer; or (e) the Operator's obligations under the General Data Protection Regulation.
16. Extra-judicial dispute resolution and supervisory authorities
A Consumer may use the following extra-judicial mechanisms:
- a permanent amicable consumer court referred to in the Act on Trade Inspection of 15 December 2000;
- mediation by the Provincial Inspector of Commercial Inspection;
- the assistance of a district or city consumer ombudsman, or of a social organisation aimed at protecting consumer rights;
- the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
For matters concerning personal data, the User may lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych) in Warsaw.
17. Personal data and Data Processing Agreement
Processing of the User's personal data by the Operator is governed by the Privacy Policy. Where the User publishes a Generated Site that collects personal data of visitors through forms or other means, the Operator acts as processor on behalf of the User, who is the controller. The terms of that processing are set out in the Data Processing Agreement, automatically concluded between the User and the Operator upon acceptance of these Terms.
18. Amendments
The Operator may amend these Terms. Amendments are notified to the User by e-mail and by an in-app notice with at least 14 days of advance notice before they take effect. A User holding an active Access Pass at the time of notice may continue under the pre-amendment Terms until the Access Pass expires.
19. Termination by the User
The User may terminate the agreement at any time by deleting the Account. Termination does not entitle the User to a refund of any used or unused portion of an active Access Pass, save where mandatory consumer law requires otherwise; see the Payment and Refund Terms.
20. Governing law, jurisdiction and language
These Terms are governed by Polish law. For disputes with an Entrepreneur, the courts having jurisdiction over the seat of the Operator (Warsaw, Poland) are competent. For disputes with a Consumer, the courts of the Consumer's place of residence are also competent under Article 18 of Regulation (EU) 1215/2012 (Brussels I-bis). These Terms are made available in Ukrainian, English and Polish. The English version is the master version; in case of any conflict or discrepancy between language versions, the English version prevails. If any provision is held invalid or unenforceable, the remaining provisions remain in force.

Note: under Article 38 point 13 of the UoPK, the right of withdrawal does not apply where the Consumer expressly consented to immediate provision of the digital service and acknowledged the consequent loss of the right of withdrawal, as described in Section 12.
