1. General provisions and acceptance
These Terms of Service (the Terms) govern the relationship between Goup Space Sp. z o. o., ul. Hoża 86/210, 00-682 Warszawa, Poland, KRS 0000932799, REGON 520583134, NIP 7011061440, e-mail info@otack.eu (the Operator), and any natural or legal person who registers an account on the Platform (the User). Registration constitutes acceptance of these Terms.
2. Definitions
- Platform — the web application at pages.otack.eu and its sub-domains.
- User — a natural person at least 16 years old, or a legal person, holding an Account.
- Account — the User's personal area on the Platform, secured by a password.
- Generated Site — a website produced through the Platform on the User's behalf.
- Access Pass — a one-time, non-renewing entitlement to paid features for 30 or 90 days.
- Trial — free access offered at the Operator's discretion during the demo phase.
- Consumer — a natural person acting outside their business or professional activity.
- Entrepreneur — a natural or legal person acting in connection with their business or professional activity.
- AI Provider — a third-party AI service called by the Platform (Anthropic, OpenAI, Google, Moonshot, or compatible).
- Content — any text, image, code, prompt, or other material submitted, generated, or published through the Platform by the User.
- Stripe — Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland.
3. Description of the service
The Platform offers AI-driven website generation, a visual editor, export as ZIP archive, SFTP deployment, CMS package export, and multilingual generation. Hosting of Generated Sites on Operator-controlled subdomains is a planned future feature, not yet available.
The Platform is provided "as is". The Operator does not warrant that AI-generated output is accurate, lawful, unique, free of third-party rights, or fit for any particular purpose. The User must review all output before publication and is solely responsible for published content. The Operator does not warrant uninterrupted or error-free operation.
4. Technical requirements
A current version of Chrome, Firefox, Safari, or Edge with JavaScript and cookies enabled, a stable internet connection, and unrestricted access to the Stripe checkout domain. Support: info@otack.eu.
5. Registration, Account and minimum age
The User must provide accurate registration data and is responsible for password confidentiality and all activity under the Account. One Account per natural or legal person. By registering, the User confirms being at least 16 years old (digital-consent age under GDPR Art. 8 as implemented in Poland). Accounts of persons under 16 may be terminated. The Operator may block an Account for breach of these Terms (see §14).
6. Consumer or Entrepreneur status
At purchase the User indicates whether they buy as a Consumer or Entrepreneur. A sole proprietor acting in a non-professional capacity benefits from consumer protections under Art. 7aa of the Polish Consumer Rights Act of 30 May 2014 (ustawa o prawach konsumenta, the UoPK). The Operator may seek reasonable confirmation of business status.
7. AI keys and AI providers
The User may connect their own API key for an AI Provider. The key is encrypted in the User's browser and the Operator does not receive the encryption password, does not persist the key in readable form, and does not log it. The key is held in server memory only for the duration of the single request to the AI Provider, then discarded. Full technical details are in the Privacy Policy §9.
The User is responsible for compliance with the chosen AI Provider's terms and for any usage charges under their own key. During demo or trial the Operator may provide a platform-key fallback.
8. Acceptable use and prohibited content
The User must not use the Platform to generate, store, host, distribute, or publish:
- malware, phishing pages, credential-harvesting forms, or content compromising security;
- sexually explicit content depicting or sexualising minors;
- content inciting violence, hatred, or discrimination on protected grounds;
- content infringing third-party intellectual property or trade-mark rights;
- content unlawful in Poland or in the jurisdiction where the Generated Site is published;
- automation violating rate limits, circumventing platform controls, or scraping the Platform;
- false personation, fraudulent commercial offers, or content prohibited by Stripe's Acceptable Use Policy.
The Operator may remove offending content and suspend or terminate the Account (see §14).
9. Notice-and-takedown
When Operator-hosted subdomain hosting becomes available, the Operator will handle takedown notices for allegedly unlawful content on Generated Sites in accordance with Arts. 14 and 16 of Regulation (EU) 2022/2065 (Digital Services Act). Notices may be sent to info@otack.eu.
10. Intellectual property
Content the User creates or uploads remains the property of the User. The Platform itself — source code, templates, AI prompts, and design system — remains the property of Goup Space Sp. z o.o.
The User grants the Operator a non-exclusive, royalty-free, worldwide licence to host, store, transmit, cache, and display the User's Content solely to provide the Platform. The licence terminates on deletion of the Content or Account. Scope is governed by Arts. 41 and 50 of the Polish Act on Copyright and Related Rights of 4 February 1994.
Generated output. All HTML, CSS, JavaScript, images, and other files produced by the Platform as a Generated Site are the property of the User from the moment of generation. The Operator makes no claim of ownership over generated output. On export, all rights to the exported files transfer fully and exclusively to the User; the Operator retains no licence or interest in exported files after export.
AI-generated content. Generated output may include text, images, and code produced by third-party AI Providers. The User acknowledges that: (a) the Operator does not warrant that AI-generated content is original, accurate, free of third-party intellectual property rights, or suitable for any particular purpose; (b) it is the User's sole responsibility to verify that AI-generated content does not infringe copyright, trade marks, or other rights before publishing; (c) the Operator is not liable for any claim arising from the User's publication of AI-generated content.
Hosted publishing on otack.me. The Operator offers an optional hosted publishing feature that makes the User's Generated Site accessible on a subdomain of otack.me (e.g. yoursite.otack.me), hosted on the Operator's shared infrastructure. The following conditions apply:
- Hosted publishing is available to Users with an active paid Access Pass. One subdomain is included per active Access Pass; additional subdomains may be available as a paid add-on.
- Storage per subdomain is limited to 1 GB. The Operator may suspend access to a hosted site that exceeds this limit until the User reduces its size.
- The subdomain is allocated on a first-come, first-served basis and is not transferable.
- The hosted publishing service is provided "as is" with no uptime guarantee or SLA. The Operator is not liable for downtime, data loss, or inaccessibility of hosted sites.
- The User retains full ownership of all content published on their subdomain. The Operator does not review content before publication. The User is solely responsible for ensuring all published content complies with applicable law.
- Custom domains are not supported under this feature; the subdomain is exclusively under otack.me.
- Form submissions collected through a hosted site are stored by the Operator on behalf of the User as processor, under the terms of the Data Processing Agreement. The User is the controller of all visitor data collected through their hosted site.
- If the User's Access Pass expires and is not renewed within 30 days, the hosted site and all associated data are permanently deleted without further notice. The User is responsible for exporting their site before expiry.
- On account termination for breach, the hosted site is taken offline immediately; the 30-day grace period does not apply.
- The Operator reserves the right to suspend or remove a hosted site without prior notice if its content violates §8 (Acceptable Use) or applicable law, or if a valid takedown notice is received under §9.
User responsibility for published sites. The User is solely responsible for all content published on their Generated Site or hosted subdomain, including compliance with applicable law in all jurisdictions where the site is accessed. The Operator is not a publisher of the User's content and assumes no liability for it.
Platform IP. Templates, design system components, AI orchestration prompts, and the generation engine remain the exclusive property of the Operator. Export or hosting of a Generated Site does not transfer any rights to the underlying Platform IP used to produce it.
The Operator uses customer references (logo, name) only with the User's explicit prior opt-in consent.
11. Access Pass, payment, pricing and trial
Paid features are offered as a one-time Access Pass for 30 or 90 calendar days depending on the option selected at checkout. There is no subscription, no automatic renewal, and no automatic charge. The Operator never re-charges without a new explicit purchase. On expiry the Account is downgraded to the free tier; the User may purchase a new Access Pass at any time. Project file retention after expiry is governed by the Privacy Policy §7.
Payment. Payments are processed exclusively by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin 2, Ireland, under Stripe's terms at stripe.com/legal/end-users. The Operator acts as merchant of record. Card data is collected solely by Stripe; the Operator never receives or stores card numbers, expiry dates, or CVV codes.
Currency. All prices are in United States dollars (USD). Charges are made in USD. Any currency conversion is performed by the User's bank or card issuer; the Operator is not responsible for conversion rates or associated fees.
VAT and invoicing. Where required by applicable law, VAT or equivalent tax is applied at the rate applicable to the User's country of residence and shown at checkout before payment is confirmed. A proof of purchase is issued after confirmed payment. Buyer details may be requested at checkout for invoicing purposes.
Activation. The Access Pass is activated immediately upon Stripe's confirmation of payment. The term begins on activation and ends at 23:59 UTC on the corresponding calendar day.
Price changes. The Operator may change Access Pass prices at any time. A price change does not affect an already activated Access Pass; it remains valid at the price paid until expiry. New purchases after the effective date of a change are billed at the new price.
Trial / demo. Free Trial access may be offered during the demo phase at the Operator's discretion. The Trial is free of charge, creates no payment obligation, is non-refundable, does not convert into a paid Access Pass automatically, and may be changed or discontinued at any time without notice or compensation.
12. Waiver of the consumer right of withdrawal
Under Art. 27 UoPK, a Consumer has a 14-day right of withdrawal from a distance contract. Under Art. 38 point 13 UoPK, this right is lost where the Consumer: (a) expressly requests immediate provision of the digital service before the 14-day period elapses, and (b) acknowledges the consequent loss of the right of withdrawal.
The Operator captures both declarations as two separate, non-pre-ticked checkboxes at checkout. Both must be ticked before the order proceeds. The wording is:
- "I request immediate provision of the digital service before the 14-day withdrawal period ends."
- "I acknowledge that I thereby lose my right of withdrawal once provision begins."
The timestamp and wording of each declaration are recorded on the order.
13. Refunds and cancellation
Outside the statutory consumer-protection cases in §12, an activated Access Pass is non-refundable, including for any unused remainder of the term. Used AI credits are non-refundable under any circumstances. The unused portion of any add-on AI credit pack is refunded only where mandatory law explicitly requires.
Where the Operator suspends or terminates an Account for material breach of these Terms, the User is not entitled to a refund of the activated Access Pass; mandatory consumer-protection rights remain reserved.
The User may terminate at any time by deleting the Account. Termination does not entitle the User to a refund of any used or unused portion of an active Access Pass, save where mandatory consumer law requires otherwise.
For approved refunds, the Operator returns funds via the original Stripe payment method within statutory deadlines.
14. Suspension and termination for breach
On identifying a material breach — including violation of §8 or fraudulent payment activity — the Operator may block Account access, notify the User by e-mail with grounds, and allow a cure period of 14 to 30 days proportionate to the breach. If the User fails to cure or rebut within that period, the Operator may terminate the Account and delete User data, subject to legal retention obligations. The User may appeal by writing to info@otack.eu.
15. Complaints
Under Art. 8.1.4 of the Polish Act on Providing Services by Electronic Means of 18 July 2002 (UoŚUDE), the User may file a complaint at info@otack.eu within 30 days of the event, identifying the Account, issue, date, and circumstances. The Operator responds within 14 calendar days. For payment-card disputes, the User may also use the chargeback procedure available through their card issuer; the Operator reserves the right to contest chargebacks where unjustified.
16. Liability
To the maximum extent permitted by applicable law, the Operator excludes liability for:
- inaccuracy, unlawfulness, or unsuitability of AI-generated output;
- unavailability or interruptions of the Platform;
- acts or omissions of third-party AI Providers, payment processors, hosting providers, and carriers;
- loss caused by the User's own acts or omissions;
- force majeure events, including war, sanctions, natural disasters, telecommunications outages, AI-provider outages, Stripe outages, and government action.
The Operator's aggregate monetary liability is limited to the total amount paid by the User to the Operator in the 12 months preceding the event; for a User who has made no payments the cap is zero.
These limitations do not exclude or limit: (a) liability for intent or gross negligence; (b) liability for harm to life or health; (c) any liability that cannot be excluded under Polish or EU mandatory law; (d) mandatory consumer-protection rights; or (e) the Operator's obligations under GDPR.
17. Extra-judicial dispute resolution
A Consumer may use:
- a permanent amicable consumer court (Act on Trade Inspection of 15 December 2000);
- mediation by the Provincial Inspector of Commercial Inspection;
- a district or city consumer ombudsman or consumer-rights organisation;
- the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr (Regulation (EU) 524/2013).
For personal data matters: complaint to PUODO in Warsaw.
18. Personal data and Data Processing Agreement
Processing of User personal data is governed by the Privacy Policy. Where the User publishes a Generated Site collecting visitor personal data, the Operator acts as processor under the Data Processing Agreement, concluded automatically upon acceptance of these Terms.
19. Amendments
Amendments are notified by e-mail and in-app notice at least 14 days before taking effect. A User holding an active Access Pass at the time of notice may continue under the pre-amendment Terms until the Access Pass expires.
20. Governing law, jurisdiction and language
These Terms are governed by Polish law. For disputes with an Entrepreneur: courts of Warsaw (seat of the Operator). For disputes with a Consumer: also the courts of the Consumer's place of residence (Regulation (EU) 1215/2012, Art. 18). These Terms are available in Polish, English, and Ukrainian. The English version is the master version. In case of any conflict between translations, the English version prevails, subject to mandatory provisions of the law applicable to the User's place of residence. If any provision is held invalid, the remaining provisions remain in force.

Note: under Art. 38 point 13 UoPK, the right of withdrawal does not apply where the Consumer expressly consented to immediate provision of the digital service and acknowledged the consequent loss of that right, as described in §12.
